AGREEMENT TO TERMS

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Monolith Technologies Inc ("Company", "we", "us", or "our"), concerning your access to and use of the https://shopsavvy.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, then you are expressly prohibited from using the Site and you must discontinue use immediately.

BUSINESS PRODUCTS (DATA API, SHOPSAVVY FOR BUSINESS, SEARCH API, DATA LICENSING)

The ShopSavvy Data API, ShopSavvy for Business, the ShopSavvy Search API and ShopSavvy Data Licensing are governed by the ShopSavvy B2B Terms, not by these Terms of Use. Where these Terms of Use restrict commercial use or the systematic retrieval of data, those restrictions do not apply to use of those products under the B2B Terms. These Terms of Use continue to govern the free ShopSavvy apps, website and browser extensions.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, international copyright laws, and international conventions.

USER REGISTRATION

You may be required to register with the Site. You agree to keep your password confidential and will be responsible for all use of your account and password. We reserve the right to remove, reclaim, or change a username you select if we determine, in our sole discretion, that such username is inappropriate, obscene, or otherwise objectionable.

PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

• Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
• Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
• Use the Site to advertise or offer to sell goods and services.

MOBILE APPLICATION LICENSE

Use License

If you access the Marketplace Offerings via a mobile application, then we grant you a revocable, non-exclusive, non-transferable, limited right to install and use the mobile application on wireless electronic devices owned or controlled by you, and to access and use the mobile application on such devices strictly in accordance with the terms and conditions of this mobile application license contained in these Terms of Use.

PAID PLANS, AUTO-RENEWAL AND CANCELLATION

The ShopSavvy apps, website and browser extensions are free to use. Some features are part of optional paid plans: ShopSavvy Pro and Deep Research (in the iPhone, iPad and Android apps and on the website), QR Code Reader Pro (in the QR Code Reader app), and the Pro and Max plans of the ShopSavvy Desktop app. A plan may be a weekly, monthly or yearly subscription, or a one-time lifetime purchase.

• Price. The price, billing period and currency are shown in the app or on the checkout page before you confirm the purchase. Prices can differ by store and country and can change over time; you are charged the price you confirmed.
• Payment. Purchases in the iPhone, iPad and Mac App Store apps are charged to your Apple Account when you confirm. Purchases in the Android app are charged to your Google Play account. Purchases on shopsavvy.com and in the directly downloaded desktop app are charged to your card by our payment processor, Stripe.
• Auto-renewal. Subscriptions renew automatically at the end of each period, at the then-current price for your plan, unless you cancel at least 24 hours before the end of the current period. For App Store and Google Play subscriptions, the renewal is charged within the 24 hours before the current period ends.
• Free trials. If a plan includes a free trial, its length is shown before you confirm. You are charged for the plan when the trial ends unless you cancel at least 24 hours before it ends. When you buy a subscription during an App Store free trial, any unused part of the trial ends.
• Lifetime purchases are a single payment and do not renew.
• How to cancel. Cancelling stops the next renewal; you keep the plan until the end of the period you paid for. Deleting the app does not cancel a subscription.
  • App Store (iPhone, iPad, Mac): Settings > your name > Subscriptions, or the App Store's account page on a Mac.
  • Google Play: Play Store > your profile > Payments & subscriptions > Subscriptions.
  • shopsavvy.com and the directly downloaded desktop app: Manage subscription in your account or the app's settings, or email support@shopsavvy.com.
• Refunds. App Store and Google Play purchases are refunded by Apple or Google under their own policies (reportaproblem.apple.com, or the Google Play order history). For purchases made on shopsavvy.com or in the directly downloaded desktop app, contact support@shopsavvy.com.

The paid business products (Data API, ShopSavvy for Business, Search API and Data Licensing) have their own billing terms in the ShopSavvy B2B Terms.
